1. Agreement to Terms

By accessing and purchasing from the TintaLux website ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and TintaLux. If you do not agree with any part of these Terms, you must not use or make purchases from our Site.

2. Products and Orders

TintaLux sells premium stationery, including but not limited to Notebooks & Journals, Fountain Pens, and File Folders & Bags. All product descriptions, images, and prices are subject to change without notice. We reserve the right to limit quantities, discontinue products, or correct errors in pricing or product information. Your order constitutes an offer to purchase, which we accept upon sending an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, inaccuracies, or inventory issues.

3. Limitation of Liability

To the fullest extent permitted by applicable law, TintaLux, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or the products purchased, including but not limited to loss of profits, data, or goodwill. Our total cumulative liability for any claims arising from these Terms or your use of the Site shall not exceed the total amount you paid to TintaLux for the specific product giving rise to the claim in the twelve (12) months prior to the claim. This limitation applies regardless of the legal theory (contract, tort, or otherwise).

4. Intellectual Property Protection

All content on the TintaLux Site, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of TintaLux or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. The "TintaLux" name and logo, and all related product and service names, are trademarks of TintaLux. You may not use any meta tags or any other "hidden text" utilizing TintaLux's name or trademarks without our express written consent. Any unauthorized use terminates the permission or license granted by TintaLux.

5. Refund & Return Policy

We strive for your complete satisfaction. If you are not satisfied with your purchase, you may return most new, unopened, and unused items in their original packaging within 30 days of delivery for a full refund of the product price. Return shipping costs are the responsibility of the customer, unless the return is due to our error (e.g., wrong or defective item shipped). Refunds will be processed to the original method of payment within 10 business days after we receive and inspect the returned item. For hygiene reasons, fountain pens that have been inked or used cannot be returned unless defective. 6. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
